Terms and conditions

Version 2, November 2026. Correction in A1 and A2 without any change in substance. This translation is for convenience, the German text is authoritative.

Part A applies as soon as you register an account. Part B only applies once sales start. Nothing is being sold at the moment. Part C applies to both parts.

Provider

Paul Buyse, trading as 121 Studios, Heimstättenstraße 3, 82166 Gräfelfing, Germany, +49 174 2379106, contact@121-studios.com. Below “we”.

Part A: Terms of use for your account

A1. Account. The account is free of charge. You provide correct details and keep your mail address up to date, because we use it to send order confirmations and important messages. If you are a minor, you need your parents' consent.

A2. Access. Keep your password secret and do not pass your account on to others. Tell us if you suspect access by someone else. Signing in through Steam or Google is voluntary, see privacy.

A3. Support. You can send us requests through your account. There is no entitlement to a specific response time. Statutory rights remain unaffected.

A4. Blocking. We may block your account wholly or partly for good cause, such as abuse, attacks on our systems or a breach of the license in Part B. We hear you first, unless security does not allow this. We tell you the reason. The block ends when the reason no longer applies. Your statutory rights from a purchase remain in place, see B10.

A5. Deletion and termination. You can delete your account at any time. Downloads and updates provided through the account are then no longer available to you there, so save what you need first. What we must keep due to statutory retention obligations is described in the privacy policy. We can only terminate your account for good cause. If the cause is a breach of these terms, we warn you first or set a deadline, unless special circumstances justify immediate termination. Your statutory rights from a purchase remain in place, see B10.

A6. Changes. A new version of Part A only applies once you agree to it. If you do not agree, the previous version continues to apply to your account. A purchase is governed by the version of Part B that applied when you ordered.

A7. Redeemed codes. If you redeem a license code in your account, including one passed on to you or provided free of charge, B7 to B9 and B11 apply to your use. The code is then bound to your account.

Part B: Terms of sale (apply once sales start)

B1. What you buy. We sell digital content: maps as addons for the bus simulator OMSI 2, delivered as a download. The product page describes what each map includes. Your contract partner is us, not the payment provider.

B2. Requirement. To play you need your own purchased copy of OMSI 2. The base game is not included and we do not supply any files of the base game. No additional addons are required unless the product page states otherwise.

B3. Conclusion of contract. The presentation in the shop is not yet a binding offer. You need an account to order. Before ordering you see the map and the total price in the order overview and can change your details. With the “Place binding order” button you make a binding offer. You then pay on the page of our payment provider Stripe. The contract is concluded when the payment has succeeded and we confirm this by mail. If you cancel the payment, no contract is concluded. You receive the contract text by mail with the order confirmation. The contract language is German.

B4. Prices and payment. The price shown on the respective product page and in the order overview at the time of the order applies. It is the final price and includes VAT where it applies. The tax rate can depend on your country, the final price does not change as a result. There are no shipping costs. Payment is handled by Stripe. We offer card payment, PayPal, Revolut Pay and, depending on your device, Apple Pay and Google Pay. You see the available payment methods when you start your order. We deliver to all countries from which our payment provider accepts a payment. You receive an invoice by mail.

B5. Delivery. After successful payment you receive an order confirmation by mail with a link to your order in your account. There you choose: With “Redeem in my account” the map is assigned to your account and you can download it. With “Pass code on to someone else” we show you the license code, which the other person can redeem in their account. The current size is on the product page. There is no shipping on physical media. You can download each version of the map twice per purchase. A download counts as soon as we create the download link. The link is valid for 24 hours, during which you can interrupt and resume without it counting again. If a download fails later or the downloads are not enough, write to us. We release further downloads if there is a reason. We do not set a minimum or maximum duration for download access: As long as we operate this service, the map stays available in your account. If we discontinue it, we will tell you by mail in good time beforehand so that you can save the map. Your statutory rights remain unaffected.

B6. Withdrawal. Consumers have a right of withdrawal. It belongs to the buyer. It ends early if you agreed and confirmed this in the order overview and performance has begun. Performance begins as soon as you click “Redeem in my account” or “Pass code on to someone else” in your order. After that we do not refund the purchase price following a withdrawal, even if you have not downloaded anything yet. Details are in the withdrawal policy.

B7. License. You receive the simple right, unlimited in time, to install and use the map for your private use on your PC. You may only use it on a second PC if it belongs to you and only you have access to it. In particular, passing the files on to others, making them publicly available, reselling them and using parts of the map in other projects are not permitted. Changes to the map files and repaints are not intended and are not covered by this license. You may pass a license code that has not been redeemed yet on to another person, for example as a gift. Once redeemed it is bound to the account and can no longer be passed on. All other rights remain with us and the respective rights holders. Mandatory statutory rights of use remain unaffected.

B8. Identifier and passing on. Delivered copies contain an identifier assigned to the respective purchase. If a copy is published without permission, it lets us determine which purchase the copy comes from. The identifier contains no details about a person. The assignment to the purchase and to the account in which the code was redeemed exists only with us. You may not remove or change it. A find only shows which purchase the files come from, not who published them. We therefore hear you before we take any step against you. In case of a breach we can report the publication to the provider concerned, block your account and future downloads under A4 and assert our statutory claims, such as injunctive relief and damages. Details on the data are in the privacy policy.

B9. Streams, videos and images. You may show and stream images and videos of your gameplay with our map, including on channels with ads or income. The map files may not be passed on in the process. Rules of the base game OMSI 2 and of the platform concerned remain unaffected.

B10. Defects and updates. The statutory rights for defects in digital products apply (Sections 327 ff. BGB), including the duty to provide you with updates needed to keep the product in conformity and to inform you about them, for the period you can expect given the nature and purpose of the map. If you are blocked under A4, we provide such updates to you another way. We always inform you about them, even if the setting “Notify me about updates” is off. We do not owe new routes or other new content unless we have expressly promised them. If a payment is charged back or refunded in full, we block the license code and future downloads for this purchase, even if someone else redeemed it. If a chargeback is decided in our favor, we lift the block. Whoever redeemed the code receives updates through their account. The statutory rights for defects belong to the buyer.

B11. Third party map data. The map is also based on third party data, among others from OpenStreetMap. Sources and licenses are listed in the manual. B7 does not restrict rights these licenses give you in the data itself.

Part C: For both parts

C1. Liability. We are liable without limitation for intent and gross negligence, for injury to life, body and health, for fraudulently concealed defects, to the extent we have given a guarantee, and under the German Product Liability Act. In cases of slight negligence we are only liable for breach of a duty whose fulfilment makes performance of the contract possible in the first place and on which you may regularly rely, limited to typical, foreseeable damage. Back up your OMSI 2 folder before installing.

C2. Consumer dispute resolution. We are not obliged to take part in dispute resolution proceedings before a consumer arbitration board and do not take part in them.

C3. Law. German law applies. Mandatory consumer protection rules of the country where you live remain unaffected.
